Participation terms and liability release

Please read these terms before joining a Cedar Valley Biz Walk. By choosing to participate, you acknowledge these terms and agree to them. If you do not agree, do not participate.

Cedar Valley Biz Connect, LLC operates Cedar Valley Biz Walk.

Voluntary participation

Participation is voluntary. This is an informal community walk, not a guided fitness program, medical service, or professionally supervised activity. You decide whether you are able to participate safely and may leave at any time.

Inherent risks

Walking outdoors has inherent risks. They include uneven, wet, icy, or obstructed surfaces; traffic, bicycles, animals, and other people; heat, cold, storms, and changing weather; falls, collisions, illness, getting lost, and delayed access to medical care. These risks can cause property loss, illness, serious injury, or death.

You accept responsibility for assessing the route, weather, your health, and your equipment. You agree to follow applicable laws, act with reasonable care, and avoid putting others at risk.

Assumption of risk and release

You knowingly assume all risks arising from or related to your participation, whether known or unknown and whether described above or not.

To the fullest extent permitted by Iowa law, you waive and release any claims that you or anyone acting on your behalf may have against Cedar Valley Biz Connect, LLC, the company that operates Cedar Valley Biz Walk, and its members, managers, organizers, and volunteers for personal injury, death, or property damage arising from or related to your participation. This includes claims caused in whole or in part by their ordinary negligence. You also agree to hold them harmless from those claims.

This release does not cover gross negligence, reckless or intentional misconduct, or any other liability that cannot legally be waived.

Minors

Anyone under 18 may participate only with a parent or legal guardian. The parent or legal guardian is responsible for deciding whether participation is appropriate and for supervising the minor throughout the walk.

Walk information and communications

Routes, times, locations, weather decisions, and walk availability may change. We try to keep the website and emails accurate, but we do not promise that every update will be complete, current, or delivered before you travel. Check current conditions and use your own judgment.

Conversations during a walk and information on this website are general discussion, not legal, medical, financial, or other professional advice.

Your conduct

You are responsible for harm caused by your unlawful or intentionally harmful conduct. We may ask anyone to leave for unsafe, disruptive, or abusive behavior.

Iowa law

Iowa law governs these terms. Any dispute must be brought in a state or federal court with jurisdiction in Black Hawk County, Iowa. If a court finds part of these terms unenforceable, the remaining terms will continue to apply to the extent permitted by law.
